Welcome to Maaruwak.lk ("Maaruwak", "we", "us", "our"). These Terms & Conditions ("Terms") govern your access to and use of our website, mobile website, and related services (the "Platform").

By using the Platform, you agree to these Terms. If you do not agree, you must stop using the Platform.

1) Platform Nature

Maaruwak.lk is a marketplace platform where users can post advertisements, discover listings, save favourites, and communicate with other users (including swap-offer chat).

Maaruwak.lk is a platform intermediary only:

  • We do not own listed items
  • We are not the buyer or seller in user-to-user deals
  • We do not guarantee item quality, legality, or authenticity

Any transaction is made directly between users unless we explicitly launch an official payment or escrow feature in the future.

2) Eligibility

To use the Platform, you must:

  • Be at least 18 years old
  • Use a valid mobile number capable of receiving OTP messages
  • Provide accurate registration and account information

You are responsible for ensuring your use of the Platform complies with Sri Lankan law.

3) Account and Security

You are responsible for your account and all activity performed through it.

You must:

  • Keep your password and OTP confidential
  • Avoid sharing verification codes with anyone
  • Notify us if you suspect unauthorized access
  • Keep account information accurate and up to date

We may suspend or restrict accounts linked to abuse, fraud, impersonation, or policy evasion.

4) Listings Rules

When posting an advertisement, you agree that your listing will:

  • Be accurate and not misleading
  • Include honest condition and defect disclosures
  • Be posted under an appropriate category/subcategory
  • Use lawful content and images that you have rights to use

You must not list items you do not legally own or have authority to trade.

We may remove, reject, or limit listings that violate these Terms, violate law, are spam/duplicates, or create safety risk.

5) Prohibited Conduct and Content

You must not:

  • Post illegal, stolen, counterfeit, or infringing items
  • Misrepresent products, prices, ownership, or condition
  • Harass, threaten, scam, or abuse other users
  • Post hate speech, explicit sexual content, or unlawful material
  • Use bots/scrapers or attempt to disrupt/hack the Platform
  • Evade moderation or enforcement actions

We reserve the right to investigate and take enforcement action, including account suspension or termination.

6) Favourites, Swap Offers, and Messages

The Platform currently supports favourites and swap-offer messaging.

By using these features, you agree:

  • Messages are not end-to-end encrypted and are stored on platform systems
  • Swap offers, offer images, and messages are user-generated content and may not be reviewed before they are delivered to the other user
  • Communications must remain respectful and lawful
  • You will not send illegal, abusive, explicit, harassing, threatening, fraudulent, misleading, spam, unwanted, or otherwise inappropriate swap offers or messages
  • You will only share offer details, images, and content that you have the right to share
  • You will not share sensitive information (passwords, OTPs, bank credentials)

For safety, abuse handling, support, legal compliance, and policy enforcement, authorized admins/staff may review message or activity data where required. If misuse is reported or detected, we may remove or restrict content, limit access to swap-offer or messaging features, suspend accounts, or take other appropriate action.

Until in-app reporting is available, you should report inappropriate swap offers or messages by emailing dev.maaruwak@gmail.com. Please include relevant details such as screenshots, the advertisement URL, swap request reference, date/time, and a short description of what happened.

7) Seller Contact Reveal

Ad detail pages include a "Contact Seller" action that can reveal limited public seller details (such as name and mobile) when a user intentionally requests contact.

You agree to use revealed contact information only for lawful transaction-related communication and not for abuse, harassment, or unrelated marketing.

8) Transactions and Risk

All purchases, swaps, and exchanges are user-to-user arrangements.

Maaruwak.lk does not provide warranties, guarantees, or dispute outcomes for user-to-user transactions.

Users are responsible for:

  • Verifying item condition and ownership before completing a deal
  • Choosing safe meetup locations
  • Using caution when making payments

9) Fees and Future Paid Features

If paid features are introduced in the future (for example featured placements or subscriptions), pricing and related terms will be disclosed before purchase.

Where legally permitted, abuse of paid features may result in removal without refund.

10) Intellectual Property

You retain ownership of content you submit, but grant Maaruwak.lk a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content for operating, improving, and promoting the Platform.

Maaruwak.lk brand assets, platform design, and software are protected by intellectual property law and may not be reused without permission.

11) Privacy

Your use of the Platform is also governed by our Privacy Policy.

12) Suspension, Termination, and Account Deactivation

We may suspend or terminate access if you violate these Terms, create security risk, or engage in fraud/abuse.

You may deactivate your account through supported account settings flows.

Certain sections (such as safety, liability, and legal protections) survive termination.

13) Disclaimers

The Platform is provided "as is" and "as available".

We do not guarantee:

  • Uninterrupted or error-free operation
  • That listings are always accurate
  • That all users will act lawfully or complete deals

14) Limitation of Liability

To the maximum extent permitted by applicable law, Maaruwak.lk is not liable for losses arising from:

  • User-to-user transactions or disputes
  • Misrepresentation, fraud, or counterfeit items
  • Meetup incidents, payment risks, or third-party actions
  • Indirect or consequential damages

Where liability cannot be excluded, it is limited to the minimum extent allowed by law.

15) Indemnity

You agree to indemnify and hold Maaruwak.lk harmless from claims, losses, liabilities, and expenses (including legal fees) resulting from your use of the Platform, your content, your transactions, or your breach of these Terms or applicable law.

16) Governing Law and Disputes

These Terms are governed by the laws of Sri Lanka.

If a dispute arises, both parties will first attempt good-faith resolution. If unresolved, disputes will be subject to Sri Lankan courts.

17) Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date.

Continued use of the Platform after updates means you accept the updated Terms.
